Terms of Use
Please read these terms carefully before using Brikoula.
Article 1 – Purpose
These General Terms of Use and Payment (hereinafter the "Terms") define the conditions of access to and use of the "Brikoula" mobile application (hereinafter the "Application").
Brikoula is a digital platform that connects:
- People who wish to publish a need for a service or work (hereinafter "Requester")
- People who wish to offer their services or look for work (hereinafter "Provider")
Brikoula acts exclusively as a technical intermediary that connects users.
Any use of the Application implies full acceptance of these Terms.
Article 2 – Access conditions
Access to the Application is strictly reserved for persons aged 18 or over.
By creating an account, the user declares that they:
- Are at least 18 years old
- Have legal capacity
- Provide accurate and complete information
Brikoula reserves the right to suspend or delete any account that does not meet these conditions.
Article 3 – Account creation
To access the services, the user must:
- Create an account with a username and password
- Provide accurate information
The user is solely responsible for keeping their credentials confidential. Any activity carried out through the account is deemed to have been carried out by its holder.
Article 4 – Description of the service
The Application allows, in particular:
- Publishing offers of work or services
- Browsing offers on an interactive map
- Sending service requests
- Communicating through the internal messaging system
- Choosing a provider from several requests
Brikoula does not guarantee:
- That work will be obtained
- That a provider will be selected
- The quality, legality or conformity of the services performed
Article 5 – Virtual Coins system
5.1 Definition
The Brikoula Application may operate using a system of virtual credits called "Coins".
Coins are a virtual currency internal to the Application that gives access to certain features, in particular:
- Sending a service request
- Accessing certain specific information or services
Coins are in no way real currency, a financial instrument or a security.
5.2 Required use of Coins
Each request sent through the Application may require spending a set number of Coins.
The user acknowledges that:
- The number of Coins required per request may vary
- Some actions may be free or paid in Coins
- The use of Coins is mandatory where indicated in the Application
5.3 Validity and changes
Brikoula reserves the right to:
- Modify or remove the Coins system
- Set an expiry period for Coins
- Temporarily suspend their use
- Make obtaining Coins subject to payment, where applicable
Article 6 – User obligations
The user agrees to:
- Use the Application in accordance with the laws and regulations in force in Algeria
- Publish only lawful, real and genuine offers
- Provide accurate, non-misleading information
- Respect other users and behave fairly and respectfully
6.1 Responsibility for published content
The user is solely responsible for:
- The content they publish on the Application
- The information provided in offers or requests
- Files, descriptions, images or any other shared material
Brikoula acts exclusively as a technical intermediary and does not systematically review published content.
Consequently, Brikoula cannot be held liable for:
- Content published by users
- The accuracy of the information provided
- The consequences of a listing or a service
6.2 Responsibility for exchanges and discussions
Exchanges made through the internal messaging system (chat) are strictly the sole responsibility of the users involved.
Brikoula cannot be held liable for:
- The content of private conversations
- Commitments made between users
- Agreements concluded outside or through the Application
- Any inappropriate, abusive or fraudulent behavior
6.3 Prohibition of illegal or immoral exchanges
It is strictly forbidden to use the Application to:
- Organize or offer illegal activities
- Distribute content contrary to public order or good morals
- Carry out fraudulent exchanges
- Offer services prohibited by law
- Harass, threaten or intimidate other users
Any attempted illegal or immoral exchange, or one contrary to regulations, will result in:
- Immediate suspension of the account
- Permanent deletion of the account
- Possible reporting to the competent authorities
6.4 Moderation and removal
Brikoula reserves the right, without notice, to:
- Remove any content deemed inappropriate
- Suspend or close an account
- Cooperate with judicial authorities in the event of an offense
6.5 Civil and criminal liability
Any fraudulent or illegal use of the Application engages the civil and criminal liability of its author.
Article 7 – Liability
Brikoula has a best-efforts obligation regarding the operation of the Application.
Brikoula cannot be held liable for:
- The non-performance of work agreed between users
- Damage resulting from an agreement between users
- Temporary unavailability of the service
- Fraudulent use of accounts
- Force majeure events
Users contract directly with each other under their own responsibility.
Article 8 – Suspension and termination
Brikoula reserves the right to:
- Suspend an account in the event of a breach of these Terms
- Delete an account in the event of fraudulent activity
- Refuse access to the service without notice in the event of serious misconduct
The user may delete their account at any time by contacting support.
Article 9 – Personal data
The data collected is necessary for:
- Managing accounts
- Connecting users
- Processing payments
Data is processed confidentially. The user has the right to access, rectify and delete their data.
Article 10 – Changes to the terms
Brikoula reserves the right to modify these Terms at any time. The new terms take effect as soon as they are published on the Application.
Article 11 – Governing law and jurisdiction
These Terms are governed by Algerian law. Any dispute relating to their interpretation or performance will be submitted to the territorially competent Algerian courts.
